As more drivers enjoy road trips with their canine companions, seeing dogs in cars has become an everyday sight.
However, many motorists are unaware that holding a dog while driving is a clear violation of the law and dramatically increases accident risks. The Road Traffic Act has explicitly prohibited this practice for over 12 years.
Particularly among older drivers, there’s a persistent belief that “it used to be okay,” but since the law’s amendment in 2014, enforcement has become much stricter.
Consequently, authorities are consistently working to raise awareness about legal violations and promote a culture of safe driving.
The scope of legal violations is more extensive than you might think

Article 39, Section 5 of the Road Traffic Act prohibits “operating a vehicle while holding infants or animals, or in a manner that could compromise safety, such as placing objects around the driver’s seat.”
Not only is placing a dog in the driver’s seat prohibited, but allowing it to roam freely in the passenger or back seats can also result in penalties.
Violators face fines of 40,000 KRW (30 USD) for passenger vehicles, 50,000 KRW (37 USD) for vans, and 30,000 KRW (22 USD) for motorcycles. Failure to comply on-site or repeat violations could result in fines up to 200,000 KRW (150 USD) or even detention.
Allowing a dog to stick its head out of the window is also considered a visibility obstruction, leading to similar penalties.
The issue is that many drivers believe it’s acceptable for short distances or with calm dogs. However, the law applies uniformly, regardless of trip length or the pet’s temperament.
Traffic safety experts warn that animals can behave unpredictably. Even a well-behaved dog might bite the driver’s arm or interfere with steering in response to sudden braking or loud noises, potentially causing accidents.
Accident risk increases nearly fivefold

During functional parking tests, boundary line violations increased by 9.7 times, while overall driving and braking evaluations saw a 6.3-fold increase in errors.
The time taken to complete the course also increased by 40-50%, indicating a significant decline in cognitive, reaction, and operational abilities.
The authority cautions that even minor actions, like a pet suddenly moving or licking the driver’s face, can obstruct forward visibility and divert attention, severely delaying responses to unexpected situations.
In busy urban areas or residential neighborhoods, even a split second of distraction can lead to disastrous consequences.
